The New River: A Legal History PDF
By:Bernard Rudden
Published on 1985-05-16 by OUP Oxford

This book is a study of the New River Company. It gives a highly complex and comprehensive analysis of the complicated legal problems encountered from the company's inception in the in the first decade of the seventeenth century to its municipalization and conversion to a property company at the turn of the twentieth century. The problems of water supply, hygiene and even general business matters are examined in a relatively narrow framework. As s legal history, this book is full of technical terms. This book, however, is not without merits. It contains interesting chapters on shares, in which tracing the progress of some of the company stock through some of the various hands is discussed, as well as governance and finance yields.

Published on 2017-03-23 by Cambridge University Press

In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This major study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world.

French political libertarian and economist CLAUDE FRDRIC BASTIAT (1801-1850) was one of the most eloquent champions of the concept that property rights and individual freedoms flowed from natural law. Here, in this 1850 classic, a powerful refutation of Karl Marx's Communist Manifesto, published two years earlier, Bastiat discusses: . what is law? . why socialism constitutes legal plunder . the proper function of the law . the law and morality . |the vicious circle of socialism| . the basis for stable government . and more.

By:Bruno Deffains,Thierry Kirat
Published on 2004-03-01 by Routledge

The aim of the book is to highlight the law and economics issues confronting civil law countries. The following questions are addressed in this volume: to what extent have the existing codes in civil law countries been designed to incorporate economic considerations? Can the modifications made to codified rules over time be explained by a will to react to new economic constraints? Which economic problems are at the root of the revision of codes? And, given that the code is not the only source of law in civil law countries, the volume also explores the relationship between law and economics in the context of both the legislature and the courts.

By:E. Örücü,Elspeth Attwooll,Sean Coyle
Published on 1996-01-01 by

All legal systems are mixed: some more than others. There are covert mixtures and overt mixtures; stable mixtures and mixtures in transition. This book brings together a wide range of legal orders, some well known, some not so often studied. The analysis offered is far beyond a descriptive one, the general aim being to provide a basis for discussion by covering paths, methods and specific techniques, consequences and implications of legal migration. The newly emerging democracies of Eastern Europe, for example, are looking at the pool of models when re-designing their systems. Such systems in transition open up a whole new world of possibilities for research. The two final chapters on spectral jurisprudence and the conceptual search bring into focus and widen the analysis further.

Judicial Systems in Transition Economies PDF
By:James Horton Anderson,David S. Bernstein,Cheryl Williamson Gray
Published on 2005-01-01 by World Bank Publications

'Judicial Systems in Transition Economies' looks at the experience of countries in Central and Eastern Europe and the Baltics (CEE) and the Commonwealth of Independent States (CIS) as they reform their legal and judicial institutions to fit the needs of a market economy. The study shows, rather disturbingly, that less progress has been made in judicial reform than in most other areas of institutional reform in these countries. The transition from socialism to capitalism requires a fundamental reorientation of legal and judicial institutions. This study reviews the environment preceding reforms, forces that provoked and supported them, and the reform agendas undertaken in these countries since 1990. Against this background, it exposes the impact of reforms, implementation gaps, and the underlying determinants of success and failure. The report examines how courts have performed, and reveals their impact on public opinion and the business environment. It provides insight into linkages among reforms as well as linkages between reforms and public demand for a fair judiciary. The authors show that while each country presents different challenges and opportunities, certain lessons apply in most settings. Their insights and data would be useful to policy makers, judicial personnel, and those involved in reforming judiciaries. The study draws on numerous data sources. These include the World Bank, the European Bank for Reconstruction and Development (EBRD, the American Bar Association-Central European and Eurasian Law Initiative (ABA-CEELI), the World Values Survey, the World Economic Forum, and the University of Strathclyde.

Legal Terminology PDF

Published on 2006 by Delmar Pub

The key to understanding the legal profession is developing a true understanding of legal terminology. This text gives students the expert information they need to do just that. It explains complicated legal terms in accessible language and uses examples to help students understand the terms in context. The author employs an easy-to-read, narrative form with related terms and their definitions presented in logical sequence by chapter-unlike the format of a traditional legal dictionary. For example, in the chapter on domestic relations, students will follow a relationship from a couple's first meeting, to dating, moving in together, marrying, having children, contemplating divorce, and divorcing. Written as a text, study guide and reference manual, Legal Terminology for Legal Professionals will enable students to succeed in the law office setting by helping them acquire a meaningful understanding of the terminology they will face every day.

Capitalism Beyond Mutuality? PDF
By:Subramanian Rangan
Published on 2018-06-20 by Oxford University Press

Our quest for prosperity has produced great output but not always great outcomes. The growing list of concerns includes climate and natural capital, abuse of wealth and market power, economic insecurity, gender bias and disparity, competitive and immoderate consumption, and unhealthful lifestyles. Fundamentally, when it comes to well-being, fairness, and the scope of our humanity, the modern economic system still leaves much to be desired. In turn, trust in business and the liberal market system (a.k.a. |capitalism|) has been declining and regulation has been rising. Thankfully, a variety of forces-civic, economic, and intellectual-have been probing for better alternatives. The contributions in this volume, coauthored by eminent philosophers, social scientists, and thoughtful business leaders, are submitted in this spirit. Mutuality, or the exchange of benefits, has been established as the prime principle of action and inter-action in addressing the chronic dilemma of human interdependence. Mutuality is a fundament in the social contract approach and it continues to serve us well. But, to address more robustly the concerns outlined above, we need to conceive a cultural economic system that is anchored on more than mutuality. In particular, we must help evolve an economic paradigm where mutuality is more systematically complemented by reasoned and elective morality. Otherwise the design of the state as protector and buffer between the market and society will remain the central (if inadequate) remedy. The essays in this volume integrate philosophy and social science to outline and explore concrete approaches to these important concerns emanating from business practice and theory.
